Not part of the mot on cars but it is a fail  on LGV and public transport, guess he could give you an advisory to cover himself. May be worth finding another tester if he is unsure on old cars.

You will still need an MOT as a Buggy is a heavily modified classic

Although "technically" the tyre would be a fail if sticking out, I would probably look for a more Buggy Friendly MOT place

;)

And wouldn`t worry about it  :-X

Over the years I've had MOT advisories stating tyre protruding. Last year with 2" wider rears nothing :-\
As the lads say, speak to a few others, try another garage  ;-)up

Not MOT but covered here, so if you are stopped a valid MOT will not rub with any clued up traffic officer.

The Road Vehicles (Construction and Use) Regulations 1986

1986 No. 1078PART IIKRegulation 63

Wings

63.—(1) Save as provided in paragraph (4), this regulation applies to—

(a)invalid carriages;

(b)heavy motor cars, motor cars and motor cycles, not being agricultural motor vehicles or pedestrian-controlled vehicles;

(c)agricultural motor vehicles driven at more than 20 mph; and

(d)trailers.

(2) Subject to paragraphs (3) and (5), every vehicle to which this regulation applies shall be equipped with wings or other similar fittings to catch, so far as practicable, mud or water thrown up by the rotation of its wheels or tracks.

Which puts all buggies apart from Shaggy's and perhaps the kango in the non compliant group as we have nothing to stop the thrown up by the rotation of the wheel part on buggies. The IVA compliant buggies I have seen still do not have much.The good news is there are less police around these days and the paperwork involved with a non compliance makes a verbal warning or a chat about the buggy more likely.

It is strange that things that fail SVA pass the mot but then the mot is just a quick basic check to the absolute legal mimum roadworthy standard

"so far as practicable"

To me these are the key words.  So long as it is not over exposed, a rail with nothing whatsoever on the wheels springs to mind, the body has not been cut back to show more tyre and there is only a small amount of tread and sidewall showing it would be hard to do more than tell you about is (my opinion, dont send me the fine to pay)

However drive along a newly dressed road slinging stones everywhere and then it will become an issue. Bit like these 20mph school areas, drive through one at 25mph with an unmarked police car behind you - 3 in the morning probably get a severe ignoring, do it in the snow when schools are coming out you will (deservedly) get a different reaction.

Just what I think, dont fret it and find an MOT station that has a more practical tester

It's not an MOT failure, but it's covred by construction and use and is technically illegal.

A mate had a massive argument with an MOT tester over this one and in the end made the tester ring up VOSA who advised that he could not fail the mot on it.

Get a tester who knows the regulations.....
