Axle gaiters

OK so it's generally accepted that 'split' axle gaiters should have the split at 3 or 9 o'clock, rather than 12 o'clock. However my new ones, and I imagine most, have thinner walls opposite the split which I pressume is to more room between the half shafts and the chassis forks. But that would leave the split at 12 o'clock.
Still fit with the split at 3 or 9 ?

I think(!) that the split is at 3 or 9 o'clock so that it is not under any stresses or tensions as the axles traverse up and down  :-\
